Scope of application, adjustments
Your use of the Moriz Nähr- atalogue raisonné (hereinafter also referred to as “MNCR”) is subject to these terms and conditions. By registering for a user account and each time you log in, you declare that you agree to these terms and conditions.
We collect and process personal data in the course of your use of MNCR. Information on this can be found in our privacy policy, which is available here.
We reserve the right to amend these terms of use from time to time in order to take account of users' wishes or changes to our services. The date of the respective version can be found at the top of the terms and conditions.
Use of the contents
The use of the MNCR and its contents is permitted exclusively for personal, non-commercial use and for scientific research purposes.
Use of the content for the aforementioned purposes is free of charge.
Any commercial use of the MNCR and the contents of the index, either directly or through resale, is prohibited.
We expressly reserve the right to assert claims for payment of an appropriate usage fee and/or damages in the event of use of the MNCR contrary to these terms of use, in particular for commercial purposes.
Rights to MNCR and the content
The producer and rights holder of the MNCR is the Gustav Klimt | Vienna 1900 - Private Foundation (in short: Klimt Foundation) (“we”). The catalogue raisonné is legally protected. It may not be copied, distributed, reproduced or made publicly available in whole or in part. The contents of the catalogue raisonné may only be extracted and used in accordance with these terms of use.
All contents of the MNCR (whether text, image, film or audio) are protected by copyright and/or ancillary copyright. They may only be used within the framework of the MNCR for private, non-commercial or scientific purposes. Any other use requires the consent of the rights holder listed with the content. Legal exceptions (e.g. reproduction for private use or for research purposes, scientific quotation, etc.) remain unaffected.
Image files from the Klimt Foundation's collection can be requested for publications or other forms of publication via office@klimt-foundation.com. The request must be made in writing.
The Klimt Foundation does not act as an image agency and does not offer image files for sale via the MNCR. Users are requested to independently request images that have been recorded, presented and provided with a corresponding image credit in the context of the catalog raisonné for publications of any kind from the corresponding rights holders.
Please note: We ask for your understanding that written reproduction requests that do not concern the Klimt Foundation's holdings will not be processed or answered by the Moriz Nähr catalogue raisonné team.
The electronically provided data records of the MNCR may only be saved on your own computer in the form of a PDF (data sheet) that can be generated in the catalogue raisonné.
For each use, the copyright notices/credits must be reproduced exactly as they appear in the MNCR. Exceptions to this are noted separately in the respective content.
Registration and user account
The use of the MNCR requires a one-time registration. By registering, you enter into a user agreement with us, which is based on these terms and conditions.
When registering, you must provide all information completely and truthfully. We are entitled, but not obliged, to check the information provided.
We are entitled to refuse registration without giving reasons.
The user is not permitted to misuse or pass on personal access data to third parties.
The user account remains valid until it is terminated by you. Termination is possible at any time by sending an e-mail. In the event of termination, all data will be deleted from your user account. If the data is deleted, access to the catalogue raisonné is no longer possible.
We reserve the right to delete the user accounts of persons who have not logged in to the works directory for at least one year with the next deletion run. Deletion runs take place once a year.
Citation guidelines
Contents of the MNCR that are to be reproduced in scientific publications must be cited by users in accordance with current scientific standards. The MNCR should be cited in its entirety as follows:

Users are encouraged to cite datasets presented on the research platform using the general wording, permalink and retrieval date given below:

Liability and legal information
We regularly update and maintain the website and catalogue raisonné. Nevertheless, the Klimt Foundation accepts no liability for the use and constant availability of this website. The topicality, completeness and accuracy of the content cannot be guaranteed. The Klimt Foundation reserves the right to remove or change content from the MNCR for technical, editorial or legal reasons.
Links and references
The Klimt Foundation accepts no liability for hyperlinks set by users to the Moriz Nähr catalogue raisonné. It is not possible for us to constantly check the content of websites referred to at various points in the catalog raisonné. We are also not obliged to do so and accept no liability for the linked content.
Exclusion of liability (disclaimer)
Users are advised that the Moriz Nähr catalogue raisonné is explicitly a scientific research tool. The objects/archival material contained therein on the research platform are not and will not be evaluated. The Klimt Foundation distances itself from any discriminatory, violence-glorifying and National Socialist content that some data records may contain.
Final provisions
These Terms of Use shall be governed exclusively by Austrian law to the exclusion of international conflict of law rules. The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with the use of the MNCR is Vienna Innere Stadt.
